Chapter 1 is written by Kaj Hobér , Volker Roeben , and Ylli Dauta j and is titled ‘Investment Law and Energy Transition: Promotion, Protection, and Arbitration’. The authors set the scene of the anthology by explaining the object and purpose of the book, introducing the pressing issues, and summarizing the contents of each chapter (i.e.‘the dialogue’). It is true that the environment and the climate are threatened by human activity and that if we continue to emit greenhouse gases, our grandchildren may not be able to enjoy the same world as their ancestors once did. As much is considered a scientific fact and the Paris Agreement makes it clear that we need a climate-resilient development in order to limit the rise in global average temperature to 1.5℃ of pre-industrial levels. International lawyers have caught up to reality and also to understanding the role that the legal framework and legal processes play in causing as well as solving the global climate crisis. It is in that light that this book seeks to explain why economic, environmental, climate, and investment protection policies must be considered together in order to achieve an effective global governance structure for the promotion and protection of renewable energy investments. In doing so, this book invites cross-fertilization and interdisciplinary approaches to understanding the international investment law and arbitration piece of the much bigger climate change jigsaw puzzle. The book offers a true dialogue, both across subject areas (environment, climate, energy, economics, investment) and also within the authors’ diverse backgrounds (economists, lawyers, scholars, state representatives, and policymakers), and this chapter simply sets the scene for what follows in Chapters 2–13.
