Climate litigation has evolved from a tool to spur climate action into a complex arena where the quality, fairness and direction of climate measures are contested. While early climate lawsuits often aimed to compel governments or corporations to reduce greenhouse gas emissions or adapt to climate impacts, a growing share of cases now challenge how climate action is implemented. Two notable categories of climate litigation are discussed in this article. First, “just transition” litigation, which consist of cases brought by workers, communities or Indigenous groups who claim that climate policies or projects unjustly burden their rights or livelihoods. Second, “green v. green” litigation, in which climate mitigation or adaptation initiatives are challenged for harming biodiversity or other environmental values. This article situates these emerging categories of climate litigation in the broader landscape of climate-related disputes, distinguishing them from more straightforward “pro” or “anti” climate cases. Through examples from multiple jurisdictions, the article illustrates how courts are increasingly called upon to balance competing interests: decarbonization versus socio-economic equity in just transition cases, and climate goals versus conservation imperatives in green v. green cases. The analysis shows that such litigation can both delay climate action and drive improvements in policy design. It suggests that adjudicating these dilemmas is not only an exercise of aligning climate action with fundamental rights and environmental justice, but could also help shaping the legitimacy and sustainability of the low-carbon transition.
