With the new Crediting Mechanism of the Paris Agreement, States agreed to an idea that would help them to use carbon credits towards achieving their national climate targets, several years before finding consensus on rules to operationalise the idea. The underlying and widely shared expectation is that the Crediting Mechanism aligns with physical laws of climate dynamics, existing economic models and international law standards, and that it enables States to raise their ambition in setting and implementing national targets more affordably while supporting sustainable development. This article questions the legal validity of this expectation based on an in-depth assessment of the operationalising rules of the Mechanism. It argues that the existing regulatory framework fails to mitigate the significant risk that the international community will underwrite increasing global greenhouse gas emissions while individual States can demonstrate compliance with ‘net zero’ targets.
