English

This study critiques the IMO 2023 GHG Strategy and 2025 Draft Net-Zero Framework through a climate-realism lens combining legal realism, resource dependence, and securitization theory. A Norway–China comparison shows one-size-fits-all aggressive pathways fail to reconcile industry survival with climate goals, favoring gradual, inclusive, technology-neutral routes. It proposes dynamic adjustment mechanisms, differentiated carbon pricing, and transnational green-infrastructure risk-sharing.

📝 gxceed 編集解説 — Why this matters

In the global GX context

Directly engages the IMO Net-Zero Framework, the central global shipping disclosure and carbon-pricing regime, and questions fairness and feasibility of uniform transition pathways—relevant to ISSB-aligned maritime transition finance and CSRD supply-chain reporting.

📄 Abstract(原文)

Introduction The 2023 IMO Strategy on Reduction of GHG Emissions from Ships and its 2025 Draft Net-Zero Framework exhibit evident features of idealism. These instruments have not fully considered vessels’ long-term asset cycles, technological bottlenecks for zero-carbon marine fuels, cross-country disparities in shipping development, and safety constraints related to green maritime infrastructure. Methods This study integrates legal realism, resource dependence theory, and securitization theory into a climate-realism framework. It uses doctrinal legal analysis, qualitative policy evaluation, and a Norway–China comparative case study. Results The limitations of the IMO Draft Net-Zero Framework are dissected across four dimensions: transition costs, technological maturity, carbon-pricing fairness, and infrastructure security. The Norway–China comparison shows that a one-size-fits-all aggressive pathway cannot reconcile industry survival with climate governance goals, whereas a gradual, inclusive, and technology-neutral route is more sustainable. Discussion To reconcile idealism with reality, global shipping decarbonization governance should establish a dynamic adjustment mechanism matched to technological iteration, implement differentiated carbon pricing, and build a transnational risk-sharing system for green infrastructure. This would balance development rights and maritime economic security while steadily promoting shipping decarbonization.
