Low-carbon hydrogen is emerging as a key vector in the global energy transition and Brazil, with its vast renewable energy potential, is uniquely positioned to become a leading global supplier. This article investigates the current state of Brazil’s regulatory framework for low-carbon hydrogen, moving beyond a mere inventory of laws to conduct a critical analysis of its institutional design, normative gaps, and policy challenges. Employing a mixed-methods approach, the study first conducts a systematic normative mapping, using Python scripts to collect and organize an extensive database of legislative and administrative acts from 1931 to mid-2025. This quantitative inventory is followed by a qualitative content analysis of key legal instruments and policy documents to identify substantive gaps and institutional misalignments.The findings reveal a significant disconnect between Brazil's comprehensive high-level legal frameworks and the critical absence of detailed sub-legal regulations. This gap manifests in three key areas: (i) an institutional framework marked by fragmented governance and overlapping agency mandates; (ii) a lack of essential regulations concerning technical standards for infrastructure and internationally compatible certification criteria; and (iii) the absence of financial mechanisms to de-risk private investment, such as state-backed incentives and standardized offtake agreements.The study concludes that this gap between legislative ambition and regulatory reality creates a high-risk environment of legal and economic uncertainty which acts as the primary barrier for the large-scale investment necessary for Brazil to establish a competitive hydrogen industry and fulfill its potential in the global market.
