📄 Abstract(原文)
Climate change has emerged as one of the defining legal and economic challenges of the twenty-first century, generating an increasingly diverse range of disputes arising from renewable energy investments, sustainability-linked contracts, carbon markets, environmental regulation, and the global transition toward a low-carbon economy. These disputes are transnational and involve a complex interaction between private commercial interests and public environmental objectives, challenging traditional mechanisms of dispute resolution. In this context, international arbitration has assumed an increasingly significant role due to its neutrality, procedural flexibility, technical expertise, and the global enforceability of arbitral awards. This article argues that climate change is fundamentally reshaping the function of international arbitration. Rather than serving solely as a private mechanism for resolving commercial and investment disputes, arbitration is progressively evolving into an instrument of climate governance capable of facilitating the implementation of climate-related obligations and supporting regulatory certainty during the global energy transition. While arbitration offers distinct advantages for addressing transnational climate disputes, its expanding role also raises important questions concerning transparency, public participation, consistency of arbitral awards, and the reconciliation of party autonomy with broader public interests, including environmental protection and climate justice. Through a critical synthesis of recent scholarship and developments in commercial, investment, and state-related arbitration, this article examines both the opportunities and the limitations of climate arbitration. It concludes that the future legitimacy and effectiveness of international arbitration will depend upon its capacity to adapt its procedural and substantive frameworks to the evolving demands of climate governance while preserving its core principles of neutrality, efficiency, and enforceability.
