Abstract The shipping industry is receiving increasing attention due to its sustainability performance, particularly in relation to climate change. While the top-down regulation spearheaded by the International Maritime Organization (IMO) sets the tone for global reforms, its practical implementation relies on contractual arrangements between shipping actors. The article first examines such sustainability contractual clauses in charterparties, focusing on the Baltic and International Maritime Council (BIMCO) model clauses. It singles out and examines in detail clauses dealing with oil and air pollution due to them being particularly relevant to the Northern Sea Route (NSR). The article then identifies situations in which Russian law may apply to charterparties. It further discusses potential challenges in applying such sustainability contractual clauses under Russian law, calling for their broader acceptance in maritime relations. The analysis combines contemporary developments in contractual sustainability of shipping with recent Russian legal and doctrinal sources dealing with merchant maritime law, as applied specifically to the Northern Sea Route.
