📝 gxceed 編集解説 — Why this matters
In the global GX context
This paper provides a comprehensive legal framing of the energy transition under international climate law, relevant for global transition finance, corporate strategy, and policy debates on stranded assets and investment treaty protections. It underscores the tension between decarbonization commitments and existing petroleum contracts.

📄 Abstract(原文)
This chapter analyses the main considerations in the energy transition. Particularly, it examines the United Nations Framework Convention on Climate Change and the Paris Agreement, as well as the UN Sustainable Development Goals, climate change litigation and other initiatives, accounting for their influence on the energy transition. It discussed how countries are embracing the change in furtherance of their obligations towards net zero under the Paris Agreement. It shows that this development has made petroleum exploration and production companies diversify into other sources of energy in response to the energy transition. It also argues that the development has political, economic, social and legal implications for the oil-rich countries. Particularly, there are legal implications arising from stranded assets and decommissioning disputes, and human rights concerns. There are also legal consequences for rich petroleum countries that may want to support decarbonisation, as oil-rich companies may challenge them because they have been locked in petroleum contracts. This may lead to huge claims before international investment tribunals.
