English

This paper proposes an applied-research and technical-legal cooperation agenda for the IFCCT consultation, integrating international economic and environmental law with implementation conditions. It distinguishes three linked dimensions: environmental performance of production systems, capacity to demonstrate it with reliable evidence, and legal-economic conditions for market participation. Drawing on WTR 2026, it notes regulatory requirements can facilitate or restrict trade, with disproportionately high fixed compliance costs for small agri-food exporters, and asks how international cooperation can close these gaps, focusing on tropical agriculture, soil health, carbon farming, NbS, traceability and a circular bioeconomy.

In the global GX context

Fits global GX debates on how trade rules, CBAM-style measures and disclosure requirements interact with agri-food decarbonization and traceability. It adds a Global South perspective on compliance-cost asymmetry and the legal-institutional conditions for credible environmental performance claims, relevant to ISSB/CSRD supply-chain disclosure and transition finance in agriculture.

📄 Abstract(原文)

This contribution presents an agenda for applied research and technical-legal cooperation addressing the two themes of the Integrated Forum on Climate Change and Trade (IFCCT) consultation. The proposed approach brings together International Economic Law, International Environmental Law and an analysis of the institutional conditions for implementation. The starting point is a distinction between three dimensions that need to be examined together: the environmental performance of production systems; the capacity to demonstrate such performance through reliable evidence; and the legal and economic conditions governing participation in markets, fostering technology and behaviour change. The World Trade Report 2026 (WTR) recognises that regulatory requirements may either facilitate or restrict trade, depending on their design and on compliance capacities. It also identifies proportionally higher fixed compliance costs for small exporters, particularly in agriculture and food. The proposed academic contribution is therefore to investigate how international cooperation can reduce gaps between these three dimensions. Particular attention would be given to tropical agriculture, soil health, carbon farming, nature-based solutions (NbS), traceability and a sustainable circular bioeconomy.
