📄 Abstract(原文)
Climate change has ceased to be merely an environmental policy concern and has become a central question of constitutional law, administrative law, human rights law and public accountability. Governments retain considerable discretion regarding the instruments through which climate objectives are pursued. Nevertheless, recent international and national jurisprudence demonstrates that such discretion is no longer unlimited. States are increasingly required to establish legally binding mitigation frameworks, formulate measurable reduction pathways, assess the climate consequences of public decisions, regulate private greenhouse gas emissions, protect vulnerable communities and distribute mitigation burdens fairly between present and future generations.
