Abstract This paper examines the role of the Research, Development, and Innovation (RD&I) Clause as a central policy instrument for fostering technological development and competitiveness in the Brazilian oil, gas, and energy sectors. The study analyzes the regulatory design and institutional evolution of the RD&I Clause, assesses investment patterns and project outcomes over more than twenty-five years, and compares Brazil’s experience with international practices, particularly those of United Kingdom, Norway, and United States. Methodologically, the paper combines regulatory analysis, systematic examination of publicly available investment and project data, and a comparative review of international innovation policy frameworks. The results indicate that the RD&I Clause has ensured a stable and predictable source of long-term funding, enabling significant investments in human capital formation, research infrastructure, experimental development, and emerging areas such as low-carbon technologies and digitalization. While the instrument has been effective in strengthening research capabilities and fostering collaboration between firms, universities, and research institutes, challenges remain regarding the participation of domestic suppliers, and the translation of research outputs into market-ready innovations. The paper proposes policy improvements focused on strengthening strategic governance, enhancing monitoring and impact evaluation mechanisms, updating regulatory definitions to reflect contemporary innovation dynamics, and expanding supplier participation. As novel additive information, the study demonstrates how regulatory obligations, when well-designed, can operate as adaptive innovation policy tools aligned with energy transition and industrial development objectives.
