English

As firms pursue net-zero goals, coordination on carbon accounting, sustainable sourcing, recycling and green standards becomes necessary, yet competition law has long treated rival cooperation with suspicion. This paper examines how India's competition framework can accommodate sustainability collaboration without enabling hidden collusion. It offers a normative framework balancing collective climate action against cartel risk.

📝 gxceed 編集解説 — Why this matters

In the global GX context

Globally, this speaks to the emerging tension between competition/antitrust policy and climate collaboration, relevant to EU horizontal guidelines on sustainability agreements and to ISSB/CSRD-driven coordination on standards. It adds a Global South (India) perspective to a debate dominated by EU and US frameworks.

📄 Abstract(原文)

Climate change has become an immediate policy concern, fundamentally altering competitive dynamics, regulatory assessments of cooperation, and market responses to ecological risk. As firms pursue net-zero targets, coordination on carbon accounting, sustainable sourcing, recycling systems, and green standards is increasingly necessary. However, competition law has historically treated cooperation between rivals with caution, given the risk of concealed collusion. The primary challenge is to ensure that competition policy does not unintentionally hinder the collective action required for sustainability.
