📄 Abstract(原文)
The scholarly and policy responses to Article 6 of the Paris Agreement have centered around the controversy over its negotiations, the rapid legal developments it has caused, and the different pathways for its implementation. Less is known about how corporations will use Article 6 for transnational cooperation, their role in generating new forms of climate governance or climate law, and the multi-level governance challenge that arises from the interaction between corporations and the state-centric regime. This chapter aims to enrich these discussions by explaining the legal processes and practices for involving corporate actors and partnerships in market mechanisms. I argue that corporate participation in market mechanisms tests international law's ability to react and improve. Although climate change does not distinguish state and non-state actors, international law does. This distinction limits corporate use of Article 6 to deal with proliferated market-based systems, regulations, and standards worldwide. Even with this limitation, Article 6 is still best placed to provide an international legal framework to safeguard market mechanisms. The ability to interpret and stretch the application of Article 6 decides whether and how it can accommodate and regulate corporate action that is increasingly influential in the public-private or hybrid governance of market mechanisms.
