📄 Abstract(原文)
Abstract Restoring blue carbon and other marine and coastal ecosystems offers significant benefits, including helping to achieve international climate and biodiversity commitments. Yet legal barriers can prevent restoration activities from taking place. In Australia, restoration projects are constrained by state-based planning frameworks that have not been designed to capture the benefits of ecological restoration. Through a critical analysis of South Australia's planning law and its application to blue carbon projects, we demonstrate that the planning regime is largely focused on preserving the existing state of the environment and fails to effectively recognize and facilitate restoration. It thereby falls short of achieving the underlying goals and principles of good planning. We argue it is necessary and feasible to integrate ecological restoration explicitly into the planning framework, and we propose various options for law reform to facilitate restoration, which may resonate in other jurisdictions where restoration practitioners face similar legal barriers and law reform is required.
