Abstract This chapter argues that the changing Earth system in light of climate change presents unprecedented challenges for property law. Novel climate change mitigation and adaptation disputes will challenge settled property law doctrine, requiring some recalibration of its guideposts of promoting stability, efficiency, equity, and precautionary protections of the environment. Notions of ownership and property rights, including the longstanding rule of capture, will face unprecedented challenges as new technologies (such as carbon capture and sequestration and hydrogen fuels) are developed to mitigate the impacts of climate change. The success of private governance in managing disputes related to carbon reduction technologies will also require property law to empower voluntary solutions to climate problems. Importantly, novel disputes related to climate adaptation will also test settled doctrines such as nuisance in new ways, forcing property law to grapple with the foreseeability of non-stationarity and dynamically changing footprints from property uses.
