English

This paper maps Australia's evolving Commonwealth and state GHG framework for the oil and gas sector, from NGER reporting to the strengthened Safeguard Mechanism, mandatory climate-related financial disclosures, and environmental approvals. Comparing six jurisdictions, it finds convergence on emissions quantification and net-zero alignment but wide variation in prescriptiveness and regulator discretion. Queensland Land Court rulings (Waratah Coal v Youth Verdict) raise the bar for Scope 3 accountability and carbon budget consistency. It argues GHG reporting increasingly underpins transition-risk quantification and reviews decarbonization options for operators.

📝 gxceed 編集解説 — Why this matters

In the global GX context

Australia's coupling of mandatory climate-related financial disclosure with the Safeguard Mechanism offers a live test case for how project-level approvals and company-level disclosure converge — directly relevant to ISSB adoption debates and CSRD-aligned transition planning globally. The Scope 3 and carbon-budget reasoning in Waratah Coal v Youth Verdict signals how litigation may shape disclosure expectations beyond Australia.

📄 Abstract(原文)

Australia's oil and gas (O&G) sector is navigating an increasingly complex climate policy landscape as the country pursues net-zero emissions by 2050. This paper examines the Commonwealth and state GHG legislative, regulatory, and policy framework affecting the sector, tracing its evolution from emissions reporting (under NGER) toward demonstrating emissions performance and credible decarbonization pathways through the strengthened Safeguard Mechanism, mandatory climate-related financial disclosures, and Federal and state environmental approval regimes. It compares GHG assessment approaches across Queensland, NSW, Victoria, Western Australia, South Australia, and the Northern Territory, highlighting convergence around emissions quantification, an avoid–reduce–substitute–offset hierarchy, and net-zero alignment, alongside significant variation in prescriptiveness and regulator discretion. Particular attention is given to recent Queensland Land Court rulings (notably Waratah Coal v Youth Verdict), which have raised the bar for Scope 3 accountability, carbon budget consistency, and human rights considerations, with implications extending nationally. The paper situates this regulatory architecture within the climate-related financial risk disclosure (CRFD) process, arguing that Australia's GHG framework increasingly provides the evidentiary basis for quantifying transition risk. It also presents a practical summary of decarbonization methods available to O&G operators — electrification, methane management, carbon capture and storage, low-carbon fuels, and digital optimization — assessed against benefits, challenges, and approval risk. The paper concludes that transition risk is increasingly less about the survival of demand and more about sustaining competitiveness and demonstrating a credible, financially resilient emissions reduction trajectory. O&G proponents face materially similar convergence between project-level approvals and company-level disclosure internationally, and Australia's example provides a robust test for proponents weighing final investment decisions.
